This article explains how clients can request changes to the Employer of Record Contract for their EOR employees.
Change requests allow you to legally adjust certain employment-related details like job title, salary, scope, and more.
You can also request a custom amendment that Deel will review and draft for your approval.

What can and can’t be changed in an EOR contract
Requesting An Amendment
Amendments can only be created once the Quote has been accepted.
- Before a Quote is accepted the clients can simply edit the agreement without requesting the amendment.
- Amendments are only required for modifying signed agreements. Clients don’t need an amendment to edit an agreement if the Work Order Form/Quote has not been signed.
How to submit a contract change request
✅ Step 1 – Open an EOR employee's overview page
Select the People tab on the home page and click on an employee's name. In the Employee profile click on View Agreement.
✅ Step 2 – Request contract changes
Click on the Request Changes button on the employee agreement page to request a change or update to the employee's EOR agreement.
✅ Step 3 – Modify specific contract values
Clients can update various employment and compensation details through a contract amendment request.
This includes fields such as compensation (currency restrictions may apply based on the employment country), employment type, work schedule, job title, seniority level, job scope, time off, sick leave policy, probation period, start date (if it has not yet passed), entity assignment, and variable compensation.
Please note that certain changes may be subject to legal or compliance review, country-specific limitations, or may require employee signatures and/or result in a change to the deposit amount.
Custom Changes
If a value is not directly editable on the platform, clients can request a custom amendment, which will be reviewed by Deel.
Requesting a custom amendment will require Deel to review, draft and send applicable amendment documents for signature if needed.
Changes that require an employee signature will auto-generate the Work Order Form amendment, but will still need the employee’s signature for an amendment to the Employee Agreement.

✅ Step 4 – Select the Effective Date and Review the Changes
Once the contract values are modified, you can now select the effective date when you need these changes to take effect.
Review the changes and submit the request.
Some contract changes will not require an additional review and approval by Deel, while other requests will require an internal review that may take several business days.
Legal amendments need to be reviewed by our internal group.
You cannot submit additional amendment requests while an active request is still under review. Please include all your known amendment requests at one time.

Items that can be amended in an EOR agreement:

✅ Moving start date to later date
-
We can amend and backdate a signed contract's start date as long as both the current start date and the new start date are still in the future and payroll hasn’t been processed.
Examples:
- We can amend the start date from June 15th to June 3rd or vice versa so long as the amendment is made before June 3rd.
- We cannot amend the start date from June 15th to June 3rd or vice versa if the decision to do so was made after June 3rd.
If you would like to amend the start date but the new date would be a date in the past, we recommend that you add an adjustment or bonus to the employee's upcoming pay instead.
✅ Employee nationality
- This amendment request must be reviewed by Deel and will also require that the employee upload a new Proof Of Work document allowing them to work in the employment country.
✅ Job title
-
For compliance reasons, we are unable to accept C-level or Founder job titles
-
- C-level and founder titles may be changed to “Head Of” or “Director” to permit EOR contract services
-
✅ Hourly Rate for current EOR Hourly Contracts
- Please note that only the hourly rate for existing hourly EOR contracts can be amended.
- The system will also validate the rate change against country-specific minimum wage thresholds, to comply with labor laws.
- We cannot amend the currency in hourly rate change for EOR hourly contracts.
✅ Salary
- Please note that a salary decrease may need a legal review.
✅ Time off
- Please note that a salary decrease may need a legal review.
✅ Seniority level
✅ Contract term
✅ Salary
✅ Variable compensation (incentive plans)
✅ Fixed allowances
✅ Working hours

Items that can't be amended in an EOR agreement:
❌ Type of hire: Demotion from Manager > Employee
- You can not demote from Manager to Employee if the Employment Agreement has been signed by the employee, but it is possible to demote if the EA hasn’t been signed.
❌ Standard working schedule:
-
We can not force full-time employees to work hours in a different time zone than their employment country.
-
- For example, US employees can not work a standard working day based on Australian hours.
-
❌ Decrease in salary or holiday days below the statutory minimum
- The employee must have the minimum number of holiday days and salary, as per their employment country’s national law.
- National bank and public holidays in the employment country have to be observed, but not public holidays in the client’s country.
❌ Backdating employment start dates are not allowed once payroll has been processed
- Please ensure that all employment details are correct before payroll cut-off to avoid issues.
❌Create an ‘unlimited PTO' policy
- You can leave the time off as standard in the contract and make a direct arrangement with your employee, if you wish. However, due to compliance reasons, we need a definitive set number of PTO days on the employee’s agreement.
❌ End date
- We can't change the contract termination terms from an indefinite period to a definite period if employee has already signed their agreement
❌ Employee full legal name
- Minor typos and edits may be processed as an on-platform amendment, pending the Deel EOR group review
❌ Mentioning Deel or Client Details in Work Order Form
- The Work Order Form must be generic to the role
FAQs
[ACCORDION] Do I need to pay an additional deposit to make contract changes?
Possibly, depending on the type of amendment you are requesting.
Changes that will increase an employee’s severance payout in the event of a termination may result in an additional deposit.
Such changes include removing probation, increasing vacation days, or increasing salary.
For each EOR agreement, Deel will collect a maximum amount of two months’ deposit over the contract lifecycle, inclusive of the initial deposit when the contract was created.
We may charge the difference if there is a gap between this two-month deposit maximum and the additional amount needed for the amendment.
[ACCORDION] Why has my amendment been rejected?
Deel ensures that all requested amendments are fully compliant. If your amendment has been rejected, this may be because it is not legally compliant.
If you want to discuss more on this, please reach out to your Deel point of contact.
[ACCORDION] Will I know why an amendment request was rejected by Deel?
Yes. If we reject an amendment, we will send you an email clearly explaining the reason for the rejection.
[ACCORDION] Can I request a custom amendment?
Yes, you can request a custom amendment on the Deel platform that will be reviewed and drafted by our internal group.
We will draft and send any applicable amendment documents for signature, if needed.

[ACCORDION] What if the contract hasn't been signed yet?
Amendments are only required for modifying signed agreements. You don’t need an amendment to edit an agreement if the Work Order Form has not been signed.
